We reserve the right to change this Policy at any time, and if we do we will provide notice and, if you have previously given consent, ensure you consent to how we continue to use your personal data. If you do not accept and agree with our Policy, you must not access or use the Service.
1. Information we collect and use
Use of the Website for information purposes
If you use our Website only for information purposes, i.e. if you do not register for an account or use the Service or otherwise provide information to us, we do not collect personal data, except for those items of personal data which your browser sends to us in order to enable use of the Website. Those data generally include: IP address, date and daytime of access request, time zone difference to Greenwich Mean Time (GMT), specific site requested, HTTP-status code, amount of data transmitted, the website from which you visit our Website, browser type, operating system and user interface, language and version of browser software.
Information ChargePoint collects about you
ChargePoint collects different kinds of information. Each time you use our Website, or any Service, we may collect the following information from you:
your full name, username, password, title, email address, telephone number, postal code, country, location, geotracking information about your device, your ChargePoint card, user identification, user differentiator, information about your account with us, credit card or other means of payment, etc., for you to register with us.
we may collect additional information that you provide to us, such as your telephone number, full address, information about your vehicle etc., to provide you with Service notifications and your membership account information so you are able to access our charging stations, but this is optional.
we may collect further information, such as, session and scheduling data, crowdsourcing, featured usage, your vehicle make, model, year and colour, and where relevant, your affiliation or association to a company account, to enhance your use of the Website and the Service.
we collect technical information to understand how users navigate through the Website in order to improve your experience, such as your IP address, type of Internet browser and operating system you use, pages viewed and the time spent on each page, links you have clicked, the URL you visit before and after you come to our Website.
when you use our Service, we collect information about how you use the Service, including, without limitation, your ChargePoint charging station location, MAC address, charging station name, charging duration, energy consumed, power cycle patterns, current, voltage (“Session Data”) to understand usage patterns and to improve your experience using our Service.
when you use ChargePoint’s social media features to communicate with users of the Service, we will need your username and may also need other information such as charging station name and charging station location for you to provide information to other users.
some ChargePoint stations may be equipped with CCTV cameras, where your image may be captured by the camera embedded in the station, determining space availability, license plate recognition, and facial recognition for the purpose of distinguishing between multiple vehicles and users registered to a single account and for security purposes.
we may collect information you provide via online surveys and polls.
if you sign up for the Service, use the Service, or send an email or other communication to ChargePoint, we may retain those communications to process your inquiries, respond to your requests and improve our Website or Service.
All of this information is your personal data. We only collect personal data which you provide to us or have given us your permission to collect.
We also collect information about you from other third parties, such as station owners.
How ChargePoint uses your personal data
ChargePoint may use the personal data which we collect about you. For instance, in respect of the personal data you provide to us, we use this to:
process your application in order for you to create an account with ChargePoint;
manage and administer your account, including distinguishing between multiple vehicles and/or users under a single account, and information relating to charging sessions, such as duration, charge consumption, station owner and station data;
provide our Service to you including information, products and services you request from us;
provide you with information about our products, services, sweepstakes, or promotions or those of our third party partners that may interest you. Please see the “Marketing” section for further information;
process any payment of fees;
notify you of any changes to our Website or Service;
deal with any inquiries, correspondence, concerns or complaints you have sent to us;
make suggestions and recommendations about products or services that may interest you, subject to the “Marketing” section below;
to otherwise communicate with you as a customer or user regarding the use of our Website or Service;
to ensure the security and operation of charging stations;
to carry out online surveys and polls.
In relation to the personal data we collect about you, we will use this to:
operate and improve our Website and Service;
keep our Website and Service secure;
analyze and compile information on patterns of usage of the Service. We may use pseudonymized information and data to improve the Service and for ChargePoint’s marketing purposes where you have provided express consent;
ChargePoint may also sell or license pseudonymized data to third parties for marketing and research usage.
The Website and Service are intended for persons licensed to drive, typically individuals over the age of at least 16. ChargePoint does not knowingly collect any information from anyone under 16 years of age. If you are less than 16 we request that you do not submit information to us.
2. Information Sharing
We generally do not share your personal data with any third party. We may, however, do so in the following circumstances:
as part of a merger, acquisition or any form of sale of some or all of ChargePoint assets or business;
to our service providers, network and charging partners, and other contractors for the purposes of providing the Service to you (for example, to assist ChargePoint’s marketing and support platforms, and data storage);
to our partners, including, but not limited, to programs and partnerships with automobile, hardware and equipment manufacturers;
to our distributors, ChargePoint charging station owners, or authorized third parties, or their respective employees and consultants to help us provide our business service to you and to allow employees or consultants to perform their duties;
to ChargePoint charging station owners or their designee, to the extent you connect with a station owner through ChargePoint’s Connections feature;
to other users of ChargePoint where you use our social media features to provide information to other users about our Services;
for bill collection;
to resolve customer disputes or inquiries;
in the unlikely event of insolvency, bankruptcy or receivership in which your personal data would be transferred as one of ChargePoint’s business assets; and
where we are legally obligated to disclose information to the government or third parties for the purposes of national security, law enforcement or other issues of public importance.
Except as stated above, we will not disclose your personal data to any third parties for any other purposes unless we have your consent or we otherwise legally have the right or obligation to do so.
We may aggregate information and data about you and your use of the Website and Service and provide such aggregated and anonymized data to advertisers and for marketing or promotional purposes. In these circumstances, we do not disclose your personal data.
3. Security Measures
How we protect your personal data
ChargePoint has security measures in place to protect your personal data under our control. To help protect the personal data you transmit through the Website or Service, ChargePoint uses industry-standard and secure server software that encrypts the information you input before it is sent to us. In addition, ChargePoint uses standard industry practice to protect personal data against unauthorized access.
While ChargePoint takes reasonable precautions against possible security breaches of its Website, no website or Internet transmission is completely secure and we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. We are unable to guarantee the security of your personal data while it is being transmitted to our Website and any transmission is at your own risk.
How you can keep your personal data secure
You should take steps to keep your personal data safe (including your password) and to log out of your account after use. Where we have provided you, or you have chosen, a password which enables you to access certain parts of ChargePoint’s Website, or a ChargePoint Smart Card to access charge stations, you are responsible for keeping your password and ChargePoint Smart Card confidential. You must not share these with anyone or store them in a way that may allow a third party to access them. If that happens, you agree to report it immediately to firstname.lastname@example.org. ChargePoint cannot be held responsible for your failure to keep your password or ChargePoint Smart Card secure.
You should update your password periodically to help reduce the risk of unauthorized access to your account with us. When you do, you should strengthen your password with the combination of uppercase and lowercase letters, numbers, punctuation and other symbols.
4. Transfer of personal data to third countries
ChargePoint is a global company which operates its Website and Service through servers located in a number of countries. If you select a country in Europe as your country of residence, your personal data is hosted on servers within the European Union.
We will need to access or view your personal data, (including your name, full address, email address, telephone number, security question and information about your vehicle including your license number and the make, model, color of your vehicle), via a secure network from the United States in order for ChargePoint to provide you with our support services or to troubleshoot any issues to improve our support services. In order to develop and improve our products and services for users, and to provide statistical information to third parties including, but not limited to, government bodies, utilities and auto manufacturers. ChargePoint will transfer certain data back to the United States (including pseudonymized information coupled with session data such as length of charge, location of charge, amount of energy received and fee). We may also need to access pseudonymized information via a secure network from the United States for financial accounting purposes. By registering for an account and submitting your personal data you consent to the transfer, processing and/or storing of your personal data on servers located in the United States, and acknowledge that the level of data protection in the United States is not necessarily equivalent to the level of data protection within the European Union and the European Economic Area. ChargePoint, Inc., the parent company of ChargePoint Network (Netherlands) BV, is Privacy Shield Certified and complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Frameworks as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. We will take necessary steps to ensure that your personal data is treated securely and in accordance with this Policy.

This Website may contain links to third party sites. Access to any other Internet site linked to this Website is at the user’s own risk and ChargePoint is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these sites. ChargePoint provides these links merely as a convenience and the inclusion of such links does not imply an endorsement. If you provide any third party with your personal data we recommend that you read their privacy policies as ChargePoint does not control how they use their information.
We may also use your personal data to send you advertising and marketing-related information (such as newsletters and events) from ChargePoint, provided that, where required, you have provided us with your consent to receive marketing communications by way of expressly opting in.
You may at any time unsubscribe by clicking on the “unsubscribe” link at the bottom of each marketing communication or by sending an email to email@example.com.
You may be invited to receive advertisements from ChargePoint’s partners and, provided you have given your consent, you may receive marketing communications from our partners. These offers from other businesses may require you to provide information to them if you choose to accept their offers. You should remember that these offers from other businesses are made by the relevant businesses themselves and not by ChargePoint. From time to time, we may also collect information via online surveys or polls. Participation in these surveys or polls is entirely voluntary and you may easily decline to participate.
Please note that where you opt out of receiving marketing communications, we may still send you certain communications relating to your use of the Service, such as service announcements, notices about new features or information on the Service, administrative messages and communications regarding your account.
7. Account Termination
Users can request to correct and delete their account by contacting Customer Service. Such requests are typically dealt with within two (2) business days. If you want to stop using your account, it will initially be deactivated. We save your information in case you later decide to restore your account. You will be able to restore your account within 30 days. After the expiration of 30 days, your account and information will be removed and deleted.
Removed and deleted information may remain in backup copies for up to one-hundred eighty (180) days to enable restoration, but will not be accessible to others in the meantime.

If you need to update your information you can do this through the Website.
